This creates an awkward gap between legal liability and marketing reality. Microsoft has been pushing hard to monetize Copilot for enterprise customers, but the public terms treat it like a toy. The company isn't unique here. OpenAI and xAI both include similar language cautioning users not to treat model outputs as factual truth, as Tom's Hardware noted. AI providers want to sell productivity while disclaiming responsibility for errors.

The picture looks different for enterprise contracts. Private agreements for Microsoft 365 Copilot and Azure OpenAI Service include indemnification clauses where Microsoft covers copyright claims from AI-generated content. Google's Vertex AI and AWS's Bedrock offer comparable protections to business customers. Consumer terms say "use at your own risk." Business customers get legal safeguards that acknowledge these tools are meant for real work.

Anthropic has faced similar scrutiny over geographic inconsistencies in its terms, with European users seeing commercial-use restrictions that don't appear for US customers. Microsoft's commitment to update its language suggests the company recognizes the current stance is untenable. Until then, anyone integrating AI agents into their workflow should understand the legal gap between what companies promise and what they'll actually stand behind.
